Texas Attorney General Ken Paxton announced his lawsuit against the City of Dallas on Thursday over a new marijuana ballot measure, arguing it violates state law. The measure prevents law enforcement from making arrests or issuing citations for marijuana possession or considering the odor of marijuana as probable cause for search or seizure.

The state’s petition contends the measure conflicts with Section 481.121 of the Texas Health and Safety Code, which criminalizes marijuana possession in any amount, and Section 370.003 of the Texas Local Government Code, which expressly forbids municipalities from adopting policies that don’t fully enforce drug laws.

The amendment prohibits Dallas Police from making arrests or issuing citations for possession of up to 4 ounces marijuana.
